Terms & Conditions

These terms govern the rental of vehicles from MagdaCars, a premium car rental service operating on the Costa del Sol, Spain, with locations at Málaga Airport, our Marbella Central Office and our Benalmádena office.

By making a reservation with us you agree to these terms. Please read them together with the rental agreement you sign at pickup, which contains the specific details of your vehicle and cover.

A reservation request is not a confirmed booking. Once we review availability and approve your request, we email you a secure payment link that is valid for 48 hours.

Your chosen vehicle and dates are only held once your reservation deposit or full payment is received. Availability is confirmed at the time of payment; if the vehicle is no longer available for your dates, no payment is taken and we will contact you.

If the payment link expires without payment, the reservation is automatically cancelled and the vehicle is released.

All prices are quoted and charged in euros (€) and include applicable taxes unless stated otherwise. Longer rentals may qualify for reduced daily rates, shown at the time of booking.

You may secure your booking with a minimum 20% reservation deposit, with the remaining balance payable at pickup, or pay in full in advance to receive a 5% discount on the rental total.

Card payments are processed securely by our payment provider, Stripe. A pre-authorisation or security deposit hold may apply at pickup to cover fuel, tolls, fines or damage; this is released after the vehicle is returned in acceptable condition.

The main driver must hold a valid, full driving licence that has been held for the minimum period required for the vehicle category. Minimum age and licence requirements may vary by vehicle and are confirmed at booking or pickup.

You must present your original physical driving licence and a valid passport or national ID at pickup. Details entered online are for reference only and are verified in person. We reserve the right to decline a rental where documents cannot be verified.

The vehicle may only be driven by drivers named on the rental agreement and must be used lawfully and with reasonable care. It may not be sub-let, used for hire or reward, motorsport, or driven under the influence of alcohol or drugs.

Taking the vehicle outside Spain may require prior written permission. Please return the vehicle at the agreed time, location and fuel level, in the condition it was provided.

Insurance cover is included with every rental. The scope of cover, any excess (deductible) and your responsibilities are set out in the rental agreement at pickup.

You are responsible for traffic fines, tolls, and any damage or loss not covered by the insurance, up to the applicable excess. Damage caused by prohibited use, negligence or breach of these terms may not be covered.

You may request a cancellation at any time from your account or the booking lookup. Cancellations are processed by our team, who will confirm the cancellation and issue any refund to your original card.

Cancellations made at least 48 hours before pickup are free of charge. For cancellations closer to pickup, part of the deposit may be retained. Refunds are issued via Stripe and typically appear within 5–10 business days.

Please contact us as soon as possible if you will be late. Late returns may incur additional charges. Failure to collect the vehicle without notice (a no-show) may result in the booking being treated as cancelled.

To the extent permitted by law, MagdaCars is not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be excluded under applicable law.

We are not responsible for failure to perform due to events beyond our reasonable control, including extreme weather, strikes, or supplier failures.

We process your personal data to manage your booking and comply with our legal obligations, in line with the EU General Data Protection Regulation (GDPR). For details on cookies and tracking, see our Cookie Policy.

These terms are governed by the laws of Spain, and any disputes are subject to the jurisdiction of the competent Spanish courts.
